Terms Of Service
1. Subject
The Region of Brittany operates a website accessible at http://msca- bienvenue.bretagne.bzh/ (hereinafter «the platform») that enables students — who have enrolled in a doctoral school attached to a public institution dedicated to higher education and research on the territory of the Region of Brittany (hereinafter «the users») — to access informations relating to doctoral studies and call for proposals open to PhD students launched by the Region of Brittany or by third parties (hereinafter «the contents»).
The Region of Brittany and the User are hereinafter referred collectively or individually as a «Party.»
The purpose of these General Terms Of Service (hereinafter the «Terms Of Service») is to determine its terms and conditions of the access of users to the platform and its contents (hereinafter «the services»), and to define the rights and obligations of the parties in doing so.
They form the entirety of the agreement between the Parties and cancel and replace any other agreement, letter, offer or any other previous written or oral document for the same purpose.
They shall be accessible at all times via a direct link on the homepage of the platform.
2. Operator of the Platform
The Platform and its Services are operated by the Region of Brittany whose address is 283 avenue du Général Patton – CS 21101, 35711 Rennes Cedex 7 (hereinafter «the Region»).

3. Acceptance of the General Terms Of Service
By accessing the website and the contents in the conditions specified herein, The User acknowledges having read the present general conditions of sale and having accepted them expressly.
This agreement can only be full and entire, without any modifications of any kind. Any conditional subscription is considered void and invalid.
If the user does not agree to be bound by these Terms and Conditions, he shall not access the Platform.
4. Non-commercial use
The User shall not trade, sell, concede, exchange and more generally, negotiate the access, in whole or in part, to the contents operated by the Region on the Platform, and to the servers of the Platform.
5. Intellectual Property
The present Terms of Services do not confer the user any intellectual property right of any kind on the Platform, as well as all the texts, images, audio/visual contents and other contents, operated by the Region on the Platform, including the present Terms of Services, brands, trade names and logos, softwares, structures, infrastructures and databases used by the Region within the Platform, that remain the exclusive, full and complete property of the Region.
Any act of dismantling, decompilation, decoding, extraction, reutilisation, and more generally any copying, performance, distribution, adaptation, commercialisation of the Platform and/or its texts, images, audio/visual contents and other contents, operated by the Region on the Platform by the User, that does not comply with the abovementioned Terms of Services, are forbidden and may be the subject of legal proceedings.
6. Prohibited behaviours
It is strictly prohibited to use the Contents for the following purposes:
- Participation in illegal activities, fraudulent activities or affecting the rights or the security of third parties.
- Violation of public order or breach of laws and regulations in force.
- Unauthorised intrusion of a third party into the computer system or any activity that might damage, control, interfere or intercept all or part of the computer system of a third party, violate the integrity or the security
- Help or incitement, in any form or by any means, to one or more acts and activities noted above:
- And more broadly, any practice of distorting contents for purposes other than those for which they were initially granted. It is strictly forbidden for any user to copy and/or distort — for his/her purpose or for the purpose of a third party — the concept, the technologies or any other element of the platform. Are also strictly prohibited: (i) any behavior liable to interrupt, suspend, slow down the access to the Platform (ii) any intrusion or attempted intrusion into the systems of the Region (iii) any diversion of the system resources of the Platform (iv) any action liable to impose a disproportionate burden on the infrastructures to the latter (v) any violation of the security and authentication features (vi) any act liable to damage the financial, commercial and moral rights and interests of the Region, and finally, more generally (vii) any breach to those present terms of service.
7. Exclusion of liability and warranty disclaimer of the Region
The User acknowledges and accepts that the Platform is a showcase site that enables the Region to give him/her an access to the Contents the Region considers relevant, related to doctoral studies on the territory of the Region of Brittany and/or to call for proposals that are local, national or European. The Region freely determines the relevant Contents that will be available on the Platform without any guarantee as exhaustiveness of the informations made available to users for this reason, which the User admits and accepts.
The User admits and accepts that the Region makes no warranty as the relevance and the exhaustiveness of the Contents available on the Platform regarding doctoral studies in general, and specific expectations of the User.
Contents are standard and not proposed to the personal interest of the User, depending on its own constraints.The Region does not guarantee that the Contents will specifically meet the needs and expectations of the User.
The User further acknowledges that the intervention of the Region is limited to provision of Contents and that the responsibility of the Region is exclusively limited to provision of Contents. The Region is under no circumstances responsible for the veracity of the online Contents, that are not regularly tested or updated.
Consequently, the Region cannot be held liable for the aforementioned Contents. Any potential complaint must be firstly made to the author of the informations contained in the Contents in question.
Furthermore, the User is solely responsible for completing the formalities and/or any other necessary actions to benefit from the informations that are contained in the Contents and cannot engage the responsibility of the Region for this reason.
8. Personal data
The Region provides a protection policy on personal data. Its characteristics are explained in the document called «Charter for protection of personal data for users». This document is available on the homepage of the Platform, and the User is encouraged to read this document.
9. Advertising
The Region shall reserve the option of inserting, on any page of the Platform and in any message to the User, any advertising or promotional message in a form and under conditions of which the Society will be the sole judge.
10. Links and third-party sites
The Region cannot under any circumstance be held liable for the technical availability of websites operated by third-party (including its potential partners) accessed by the User through the Platform.
The Region does not endorse any responsibility under contents, advertisings, products and/or services available on third-party websites: It is recalled that they are governed by their own user agreements and privacy policies, which you should read.
The Region is not responsible either for transactions which took place between the User and any announcer, professional or commercial (including its potential partners), toward which the User would be orientated through the Platform.
The Region cannot, in any circumstances, be a party to the potential litigation with third- parties concerning the delivery of products and/or services, guarantees, declarations and any other obligations the third parties may be held personally liable for.
11. Applicable law and jurisdiction
These terms Of Service are governed by the laws of France.
In case of contestation of the validity, the interpretation and/or the execution of the Terms Of Service, the User can bring proceedings either before the competent territorial court or tribunal under the Code of Civil Procedure, or before the jurisdiction of the place where he/she was living at the place and time of the event giving rise to the damage, as required by Article R.631-3 of the Code of Civil Procedure.
12. Entry into force
The present Terms of Use enters into force on 5 January 2021.
